Furthermore, Judge Connolly canceled the jury trial set to begin on September 27.

In a press release, Elysium Health’s CEO, Eric Marcotulli, expressed satisfaction with the court’s decision after a three-year litigation process. He stated that the court’s ruling, which found the Dartmouth patents licensed by ChromaDex invalid, aligned with their position.

Additionally, Eric Marcotulli emphasized Elysium Health’s serious commitment to intellectual property rights and respect for the rights of others. However, in this case, they believed that pursuing the litigation was justified and a worthwhile investment due to the patents’ evident invalidity and the potential benefits of BASIS, containing both nicotinamide riboside and pterostilbene.

ChromaDex intends to file an appeal.

Following the court’s decision, ChromaDex stated its intention to appeal.

ChromaDex released a statement on September 15, declaring their decision to appeal the ruling made on September 14. The order granted a Motion for Summary Judgment in their patent infringement lawsuit against Elysium Health, Inc. in the United States District Court for the District of Delaware.

ChromaDex holds licenses for two patents, namely U.S. Patent No. 8,383,086 (referred to as “the ‘086 patent”) and U.S. Patent No. 8,197,807 (referred to as “the ‘807 patent”), obtained from the Trustees of Dartmouth College.
