In a press release, Elysium Health’s CEO, Eric Marcotulli, expressed satisfaction with the court’s decision after a three-year litigation process. He stated that the court’s ruling, which found the Dartmouth patents licensed by ChromaDex invalid, aligned with their position.

Additionally, Eric Marcotulli emphasized Elysium Health’s serious commitment to intellectual property rights and respect for the rights of others. ChromaDex released a statement on September 15, declaring their decision to appeal the ruling made on September 14. The order granted a Motion for Summary Judgment in their patent infringement lawsuit against Elysium Health, Inc. in the United States District Court for the District of Delaware.
